Splash Aquatics Group Terms and Conditions of Enrolment, Participation & Centre Entry Effective Date: 01/01/2026 Applies To:** All Splash Aquatics Group aquatic centres, programs, and services By enrolling in any program, entering a Splash Aquatics Group facility, or participating in any activity operated by Splash Aquatics Group (“the Company”, “we”, “our”, “us”), you agree to be legally bound by the following Terms and Conditions. --- 1. Definitions * **Participant**: Any child or adult enrolled in or attending a program. * **Parent/Guardian**: The responsible adult for a participant under 18 years of age. * **Centre**: Any aquatic facility operated or managed by Splash Aquatics Group. * **Program**: Includes Learn to Swim, babies programs, squad training, aquatic education, fitness programs, events, and recreational use where applicable. --- 2. General Entry & Supervision Rules All centre entry and use conditions are enforced in accordance with recognised aquatic safety standards and industry best practice. 2.1 Supervision Requirements * Children **under 5 years of age** must remain within **arm’s reach** of a responsible adult at all times unless participating in a supervised Splash Aquatics Group program. * Children **5–10 years of age** must be actively supervised unless enrolled in a structured program. * Non-participating children and siblings remain the responsibility of the Parent/Guardian at all times. * Lifeguards are present for public safety and emergency response and are **not responsible for child supervision**. 2.2 Admission & Conduct The Company reserves the right to refuse entry or remove any person from the Centre if they: * Fail to follow safety instructions or centre rules * Display unsafe, disruptive, or aggressive behaviour * Are under the influence of drugs or alcohol * Breach signage, policies, or staff directions Removal under this clause does not entitle the participant to a refund or make-up. --- 3. Health, Medical & Fitness Declarations * Parents/Guardians must disclose any medical condition, disability, allergy, or behavioural concern that may impact safety or participation. * Participants must not attend lessons or enter the water if they have experienced vomiting or diarrhoea within the previous **48 hours**, have a contagious illness, or have open or infected wounds not appropriately covered. * The Company may request medical clearance where reasonably required. --- 4. Enrolment & Fees * Enrolments are ongoing unless otherwise stated in writing. * Fees are payable in advance via direct debit in accordance with the current fee schedule. * Failure to maintain valid payment arrangements may result in suspension or cancellation of enrolment. --- 5. Absences & Make-Up Lessons 5.1 Notification of Absence * Absences must be notified 2 hours prior to the scheduled lesson start time via your online parent portal. * Absences notified after lesson commencement are deemed unattended. 5.2 Make-Up Lessons * Make-up lessons are **not guaranteed** and are subject to availability, capacity, and like-for-like level suitability. * Make-ups may be offered as a replacement class or credit within the same term or enrolment period. * Make-ups do not roll over beyond the applicable enrolment period. 5.3 No Make-Ups Provided For * Failure to notify an absence * Late arrival or early departure * Voluntary non-attendance * Public holidays, special events, or planned closures where notice has been provided --- 6. Cancellations & Changes to Enrolment 6.1 Temporary Holds Temporary holds may be considered in exceptional circumstances (e.g. medical reasons) at management discretion and may require supporting documentation. 6.2 Permanent Cancellations * Permanent cancellation requires 2 weeks written notice via email. * A minimum [14 days / one billing cycle] notice applies. * Fees charged during the notice period remain payable. 6.3 Refunds Refunds are not provided for: * Change of mind * After entry into a facility * Non-attendance * Failure to provide required notice * Behaviour-related removals * Weather or external circumstances beyond the Company’s control --- 7. Program Changes & Instructor Substitution The Company reserves the right to: * Change instructors * Adjust class times, programs, or locations * Combine, restructure, or cancel classes where required Such changes do not constitute grounds for refund. --- 8. Photography, Video & Media * Photography or video may be taken for training, marketing, or promotional purposes. * Consent is provided at enrolment unless withdrawn in writing. * Personal filming during lessons is not permitted without staff approval. --- 9. Risk Acknowledgement & Limitation of Liability * Participation in aquatic activities involves inherent risks. * Participants engage at their own risk except where liability cannot be excluded under Australian Consumer Law. * The Company is not liable for injury, loss, or damage arising from failure to follow safety instructions, undisclosed medical conditions, or the actions of other patrons. --- 10. Personal Property Splash Aquatics Group accepts no responsibility for loss, theft, or damage to personal property. Lockers are used at the patron’s own risk. --- 11. Compliance With Policies All participants and guardians must comply with: * Centre rules and signage * Child Safe, behaviour, and safety policies * Emergency procedures and staff directions Failure to comply may result in suspension or termination of enrolment. --- 12. Extreme Weather, Force Majeure & Unplanned Closures The Company may suspend or cancel programs or centre access due to circumstances beyond reasonable control, including but not limited to: * Severe weather events (cyclones, storms, flooding, lightning) * Power or utility failures * Water quality or plant room issues * Government directives or emergency closures * Facility damage or safety concerns Where possible, advance notice will be provided. Refunds are not provided for closures under this clause. At the Company’s discretion, a make-up or credit may be offered where operationally feasible. --- 13. Behaviour Management & Removal of Participants Participants may be removed from a lesson or program if behaviour: * Poses a safety risk * Disrupts learning * Involves repeated non-compliance * Is aggressive or unsafe Where unsafe behaviour persists, the Company may suspend or permanently cancel enrolment. No refunds or make-ups apply under this clause. --- 14. Failed Payments, Debt Recovery & Direct Debit Enforcement * Failed or declined payments may result in suspension of enrolment. * The Company may reattempt debits and apply applicable dishonour or administration fees. * Outstanding debts may be recovered through debt recovery processes or third-party agencies. * Participants remain liable for all fees incurred up to the effective cancellation date. --- 15. Siblings & Non-Participating Children * Non-participating children and siblings remain the full responsibility of the Parent/Guardian at all times. * Non-participating children must not enter pool areas without permission. * Lifeguards and instructors are not permitted to supervise non-participating children. * Failure to appropriately supervise may result in lesson removal without refund or make-up. --- #16. Program Progression & Level Placement * Progression is based on demonstrated competency, safety awareness, and readiness. * Progression is **not time-based**. * Instructors have final authority regarding level placement. * Level placement decisions do not constitute grounds for refund or cancellation. --- 17. Governing Law These Terms and Conditions are governed by applicable Commonwealth legislation. --- 18.
